Article 1 – Purpose

These Terms of Use establish the rules governing access to, browsing and use of the Apex Driver website, available at:

They apply to every person who visits or uses the website, referred to below as the “User”.

Article 3 – Distinction Between Website Use and Purchases

These Terms of Use govern only access to and use of the website.

They do not govern the sale of products offered by Apex Driver.

Any purchase made through the website is governed exclusively by the Terms and Conditions of Sale, the Return and Refund Policy and the Shipping Policy accessible from the website footer.

In the event of a discrepancy concerning an order, payment, delivery, return, exchange, refund or guarantee, the Terms and Conditions of Sale and the relevant commercial policies will prevail.

Article 4 – Website Access and Availability

Apex Driver makes reasonable efforts to keep the website accessible and operational.

Access may nevertheless be temporarily interrupted, restricted or slowed due to maintenance, an update, a technical incident, a network problem, a security measure or an event outside Apex Driver’s reasonable control.

Whenever reasonably possible, Apex Driver will take the necessary measures to restore access to the website as soon as possible.

Apex Driver may modify, suspend or remove a website feature where necessary for technical, commercial, legal or security reasons, without affecting rights already acquired by Customers in connection with their orders.

Article 5 – Customer Accounts

Certain website features require access to a customer account.

The User must provide accurate information and use the email address associated with their orders.

The User is responsible for protecting their email account, device and any verification codes received. A sign-in code must not be disclosed to another person.

Any unauthorised or suspicious use of an account must be reported to Apex Driver at contact@apexdriver.shop.

Apex Driver may temporarily restrict access to an account where there is a reasonable suspicion of fraud, identity theft, a security breach or manifestly unlawful use.

Such a restriction does not deprive a Customer of their statutory rights concerning an order. The Customer may still contact Apex Driver to obtain the necessary information or exercise those rights.

Article 6 – Permitted Use

The User may access and use the website for personal, lawful purposes consistent with its normal intended use.

The User agrees to use the website reasonably and not to interfere with its operation or security or infringe the rights of Apex Driver or any other person.

Article 7 – Prohibited Uses

In particular, Users must not:

  • use the website for fraudulent, unlawful or misleading purposes;

  • impersonate another person or use another person’s information without permission;

  • transmit a virus, malware or any other harmful code;

  • bypass or attempt to bypass a security or authentication measure;

  • disrupt, overload, attack or compromise the website;

  • automatically collect or extract data without prior authorisation, including by using robots, scripts or scraping tools;

  • unlawfully collect another User’s personal information;

  • publish fake reviews or fraudulent, misleading, defamatory, threatening or unlawful content;

  • reproduce, modify, distribute or commercially exploit website content without authorisation;

  • use the website in a manner that infringes intellectual property rights or the rights of another person.

Article 8 – Intellectual Property

The Apex Driver name, logos, trademarks, graphic creations, texts, photographs, videos, illustrations, designs, visual elements, software and other website content are protected under applicable intellectual property laws.

These elements belong to Apex Driver or are used with the permission of their respective owners.

The User may view website content for personal and private purposes.

Unless permitted by law or authorised in writing, the User must not reproduce, adapt, modify, publish, distribute, sell, license or commercially exploit any part of this content.

Trademarks, software and content belonging to Shopify, Printful, CJdropshipping or other third parties remain the property of their respective owners.

Article 9 – Reviews and User Content

When a User voluntarily submits a review, comment, photograph, video or other content to Apex Driver, the User retains any rights they hold in that content.

The User nevertheless grants Apex Driver a non-exclusive, royalty-free permission to use, reproduce, display, translate and adapt the content to the extent necessary to operate, present and promote the website, store and Apex Driver products.

This permission is exercised in accordance with applicable law and the User’s rights concerning personal information.

The User confirms that they hold the necessary rights or permissions for the submitted content and that it is not unlawful, fraudulent, misleading, defamatory, threatening, discriminatory, offensive or infringing upon another person’s rights.

Apex Driver may reject, hide or remove content that is manifestly unlawful, fraudulent, abusive, promotional, automated or unrelated to the relevant product or service.

A review will not be removed solely because it expresses a negative opinion.

Article 10 – Third-Party Services and Links

The website may use or integrate services provided by third parties, including Shopify and technical, payment, tracking, communication or order-management providers.

The website may also contain links to independent websites operated by third parties.

Apex Driver does not necessarily control the content, availability or practices of these independent websites. Users are encouraged to read their own terms of use and privacy policies.

This provision does not limit Apex Driver’s responsibilities regarding its own obligations towards its Customers.

Article 11 – Personal Information and Cookies

Personal information is processed in accordance with the Apex Driver Privacy Policy accessible from the website footer.

Information about the use of cookies and similar technologies is provided through the consent-management tool and the corresponding information available on the website.

Where consent is required, Users may accept, refuse or change their choices using the tool provided for this purpose.

These Terms of Use do not replace the Privacy Policy.

Article 12 – Liability Relating to Website Use

Apex Driver takes reasonable measures to support the operation and security of the website and the accuracy of the general information displayed on it.

Material errors, interruptions or technical problems may nevertheless occur. Apex Driver may correct them once identified.

The User remains responsible for their equipment, internet connection and any reasonable measures necessary to secure their device.

Apex Driver will not be liable for damage resulting exclusively from the User’s fraudulent, abnormal or unlawful use of the website, defective equipment belonging to the User or an external event that Apex Driver could not reasonably control.

Nothing in these Terms excludes or limits liability where such an exclusion or limitation is prohibited by law.

Rights relating to products, orders, deliveries, returns, refunds and guarantees are governed by the Terms and Conditions of Sale and the corresponding commercial policies.

Article 13 – Restriction or Suspension of Access

Apex Driver may restrict or suspend access to the website or certain features where the measure is reasonably necessary to:

  • protect the security of the website or its Users;

  • prevent fraud or identity theft;

  • stop manifestly unlawful use;

  • comply with a legal obligation;

  • remedy a serious breach of these Terms.

Any measure taken must be proportionate to the circumstances.

Where a suspension affects a Customer who has placed an order, Apex Driver will preserve access to the necessary information and rights concerning that order to the extent required by law.

Article 14 – Changes to These Terms

Apex Driver may update these Terms to reflect legal, regulatory, technical, functional or website security developments.

The date of the latest update is displayed at the top of this document.

The new version applies to use of the website after its publication. It does not retroactively change the terms applicable to an order already concluded.

Article 15 – Complaints and Consumer Mediation

Complaints concerning a purchase are handled in accordance with the Terms and Conditions of Sale.

After submitting a written complaint to Apex Driver and if no amicable solution is reached, a consumer may use the consumer mediation service appointed by Apex Driver free of charge.

Article 16 – Governing Law and Jurisdiction

These Terms are governed by French law.

Users residing in another country continue to benefit from any mandatory protections applicable to them that cannot lawfully be excluded.

In the event of a dispute, the competent courts will be determined in accordance with applicable legal rules. Nothing in these Terms deprives a consumer of the right to bring proceedings before a court made available to them by law.

If there is any discrepancy between the French version and a translation, the French version will prevail to the extent permitted by applicable law.
