Depending on how you use the Services, we may collect the following categories of personal information:

  • Identity and contact information: first and last name, postal address, billing address, email address and telephone number.

  • Order information: products ordered, sizes, colours, quantities, price, currency, shipping method, order status, returns, refunds and exchanges.

  • Payment information: payment status, payment method and billing information. Complete payment-card details are processed by payment providers and are not stored directly by Apex Driver.

  • Account information: login details, preferences and history associated with your customer account, if you create one.

  • Communications: messages, customer-service enquiries, complaints and supporting materials you provide, including photographs or videos concerning a product or delivery.

  • Reviews and published content: rating, comment, display name or pseudonym, photographs and other content you choose to submit. This information may be publicly visible on the website.

  • Technical and usage information: IP address, device type, browser, operating system, online identifiers, pages viewed, links used, shopping-cart activity, visit dates and times, referring website or campaign and approximate location inferred from your IP address.

  • Marketing and privacy preferences: newsletter subscription, consents, advertising opt-outs and cookie choices.

  • Fraud-prevention and security information: technical signals, payment attempts, order inconsistencies and other information needed to protect the store and its users.

We collect this information directly from you, automatically when you use the website, or from providers involved in payments, hosting, manufacturing, delivery, tracking, reviews, analytics or advertising.

When certain information is required to enter into or perform an order, failure to provide it may prevent us from processing payment, manufacturing or shipping the product, completing delivery or responding to your request.

3. Purposes and Legal Bases

We use personal information for the following purposes:

  • Processing and fulfilling orders, taking payment, manufacturing or preparing products, arranging shipment, providing tracking and managing returns: performance of our contract with you.

  • Creating and administering your customer account: performance of the contract or steps taken at your request.

  • Responding to enquiries, complaints and customer-service requests: performance of the contract, compliance with legal obligations and our legitimate interest in providing effective customer service.

  • Complying with accounting, tax, legal and regulatory obligations: compliance with a legal obligation.

  • Preventing fraud, abuse, security incidents and unlawful payments: our legitimate interest in protecting Apex Driver, its customers and providers, as well as compliance with certain legal obligations.

  • Improving the website, measuring its audience and understanding use of the Services: legitimate interests where consent is not required, or consent where non-essential cookies or tracking technologies are used.

  • Sending marketing communications: consent where required. You may unsubscribe at any time through the link in the message or by contacting us.

  • Personalising content and advertising and measuring campaigns: consent where required, particularly in the European Economic Area.

  • Displaying and moderating customer reviews: your consent or voluntary action when submitting a review, and our legitimate interest in presenting genuine feedback and preventing fraudulent or unlawful content.

  • Establishing, exercising or defending legal claims: legitimate interests and compliance with legal obligations.

Where processing is based on your consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.

4. Cookies, Analytics and Personalised Advertising

The website uses cookies and similar technologies that are necessary for its operation, for example to secure browsing, remember your cart, maintain a session, save preferences and enable payment.

Subject to your consent where required, non-essential cookies or pixels may also be used to measure audience, analyse performance, personalise your experience and evaluate or deliver advertising campaigns. These tools may be provided by Shopify and, when enabled, by partners such as Google or other advertising and analytics services.

You may accept, refuse or change your choices through the cookie banner or the “Cookie Preferences” link available on the store. Refusing non-essential cookies does not prevent you from making a purchase, although some optional features may be limited.

When Shopify Network Intelligence or similar services are enabled, Shopify may process certain information about your activity on this store and other Shopify stores to provide enhanced features, including personalisation, analytics, security or advertising. In regions where consent is required, these non-essential uses are subject to your choice. You can change your preferences on the store and visit the Shopify Privacy Portal.

Apex Driver does not sell personal information for monetary consideration. However, certain disclosures to advertising partners may be considered a “sale,” “sharing” or “targeted advertising” under some privacy laws. Where this right applies, you may opt out through the “Your Privacy Choices” link available on the store, when displayed, or by emailing contact@apexdriver.shop.

5. Recipients and Service Providers

We disclose only the information necessary to the following categories of recipients:

  • Shopify, which provides hosting, ecommerce infrastructure and certain payment, security, analytics and personalisation features. You can read the Shopify Consumer Privacy Policy.

  • Payment providers and financial institutions to authorise payments, detect fraud and process refunds.

  • Printful, CJdropshipping and other manufacturing, printing, warehousing or fulfilment partners to prepare and ship ordered products.

  • Carriers and tracking services, including 17TRACK where used, to deliver parcels and provide their status.

  • Judge.me or another review tool enabled on the store to collect, verify, display and moderate customer reviews.

  • Analytics, marketing and advertising providers, including Google services when enabled and permitted by your consent choices.

  • Technical, security, messaging and customer-service providers necessary to operate the store.

  • Professional advisers, insurers, administrative, tax or judicial authorities, and law-enforcement bodies where disclosure is required to comply with the law or defend our rights.

Our providers may process information on our behalf as processors or, for certain activities, as independent controllers in accordance with their own legal obligations.

6. International Transfers

Some providers, including Shopify, Printful, CJdropshipping, carriers, review tools or analytics partners, may process personal information outside France or the European Economic Area.

Where required by law, these transfers rely on a recognised mechanism, such as an adequacy decision, standard contractual clauses approved by the European Commission or another appropriate safeguard. You may contact us for further information about the safeguards applying to a particular transfer.

7. Retention Periods

We retain information only for as long as necessary for the relevant purpose and then delete, anonymise or archive it with restricted access where required by law.

  • Information needed to manage an order and provide after-sales service is retained during the commercial relationship and afterwards for the time needed to handle complaints and defend our rights.

  • Invoices, accounting records and information required under accounting obligations are archived for 10 years in accordance with applicable rules.

  • Information used for direct marketing may be retained until you withdraw consent or for no more than 3 years from your last contact or relevant activity, subject to applicable rules.

  • Customer-account information is retained while the account remains active and then for a limited period needed to manage potential requests or legal obligations.

  • Customer-service requests and supporting documents are retained for the time needed to deal with the request and then for the period required to manage a potential dispute.

  • Reviews and published content may remain visible while the relevant product or service is offered, unless a valid deletion request is made or retention is necessary for evidence or fraud-prevention purposes.

  • Cookie and tracking-technology lifetimes are described in the preference-management tool and are limited to what is necessary for their purpose. Consent choices may be stored so that you are not asked again on every visit.

An erasure request does not require us to delete information that must be retained to comply with a legal obligation, preserve evidence or defend a legal claim.

8. Security

We use reasonable technical and organisational measures designed to protect personal information against loss, unauthorised access, misuse, alteration or disclosure. Because no transmission or storage method can be guaranteed to be completely secure, you should also protect your login details and never share your password.

9. Your Rights

Subject to the conditions of applicable law, you may request:

  • access to your personal information;

  • correction of inaccurate or incomplete information;

  • erasure of your information;

  • restriction of processing;

  • portability of information you provided to us;

  • objection to processing based on legitimate interests;

  • objection at any time to direct marketing;

  • withdrawal of consent;

  • information about safeguards governing certain international transfers;

  • not to be subject to a decision based solely on automated processing that produces legal effects or similarly significantly affects you, where this right applies.

To exercise your rights, email contact@apexdriver.shop and describe your request. We may request information reasonably necessary to verify your identity and protect your information. We normally respond within one month, which may be extended where permitted by law.

You may also lodge a complaint with the French Data Protection Authority (CNIL): https://www.cnil.fr.

Requests concerning information processed by Shopify for its own purposes may also be submitted through the Shopify Privacy Portal.

10. Automated Decision-Making

Automated tools may be used to identify fraud risks, secure payments or detect unusual activity. Apex Driver does not intend to make decisions producing legal effects or similarly significantly affecting you solely through automated processing, except where permitted by law and with the required safeguards.

11. Children

The Services are not intended to knowingly collect information from children who are not legally permitted to use an ecommerce service independently under applicable law. Where authorisation from a legal representative is required, a minor must use the website under that representative’s supervision. If you believe a child has provided us with information without valid authorisation, please contact us so that we can review the situation.

12. Third-Party Links

The website may contain links to services or websites operated by third parties. Apex Driver is not responsible for their privacy practices. Please review their own policies before providing them with personal information.

13. Changes to This Policy

We may update this Privacy Policy to reflect changes to our practices, providers, Services or legal obligations. The date at the top of the policy indicates when it was last updated. If a change is significant, an additional notice may be displayed on the website or sent to you where required by law.
