Terms and Conditions of Sale – Apex Driver

Article 1 – Seller’s Identity

These Terms and Conditions of Sale, referred to below as the “Terms”, are issued by:

In these Terms, the “Seller” refers to the sole-trader business operating Apex Driver and the “Customer” refers to any person purchasing a product from https://apexdriver.shop.

Article 2 – Purpose and Acceptance

These Terms define the rights and obligations of the Seller and Customer in connection with the online sale of products offered through the Apex Driver website.

They exclusively govern purchases. Access to, browsing and general use of the website are governed by the separate Website Terms of Use accessible from the website footer.

Before confirming an order, the Customer must be able to access these Terms, the Return and Refund Policy, the Shipping Policy and the Privacy Policy.

By confirming an order, the Customer accepts the version of the Terms applicable on the date of the order.

Article 3 – Products

The essential characteristics of each product are displayed on its product page. Before ordering, the Customer must review information concerning the size, dimensions, colour, material, functionality, compatibility and instructions for use.

Apex Driver makes reasonable efforts to present products as accurately as possible. Colours may nevertheless vary slightly depending on the Customer’s screen, device settings and lighting conditions.

Photographs and lifestyle images are provided for illustrative purposes without limiting the Seller’s obligation to deliver a product that complies with its description and advertised characteristics.

Some products are manufactured or printed on demand by partners such as Printful. Other products may be prepared and shipped by supplier partners such as CJdropshipping.

The use of these partners does not change Apex Driver’s responsibility towards the Customer.

The Seller may change its product catalogue at any time without affecting orders that have already been confirmed.

Article 4 – Availability

Products are offered subject to available stock and production capacity.

If a product becomes unavailable after an order has been confirmed, the Customer will be informed as soon as possible.

Where a replacement is available, the Customer may accept it. The Customer may also refuse the replacement and receive a refund for the unavailable product.

Article 5 – Prices

Prices are displayed in euros and include all taxes applicable at the time of the order.

Shipping charges and any other applicable costs are displayed before the Customer finally confirms the order.

Apex Driver may change its prices at any time. Products will nevertheless be charged at the price displayed when the order was confirmed, except in the event of an obvious pricing error.

For deliveries outside the European Union, customs duties, import taxes or administrative charges may be imposed by the authorities of the destination country where they are not included during checkout.

The Customer will be informed before ordering when the existence or amount of these charges can reasonably be determined.

Article 6 – Orders

Before confirming an order, the Customer must check the selected products, variations, sizes, quantities, prices and billing and delivery details.

Confirming the order creates an obligation to pay.

After confirmation, the Customer receives an email summarising the essential order information.

The Seller may refuse or cancel an order for a legitimate reason, including refused payment, product unavailability, clearly incorrect information, an obvious pricing error or a reasonable suspicion of fraud.

If the Seller cancels an order, any amount already collected for the cancelled order will be refunded.

Article 7 – Payment

Payment is made using the methods offered during checkout.

Payments are processed using the secure services available through Shopify. Apex Driver does not directly retain the Customer’s complete bank card details.

An order enters production or preparation after payment has been approved, unless otherwise stated to the Customer before the order is confirmed.

Article 8 – Delivery

Products are delivered to the address provided by the Customer when placing the order. The Customer must ensure that the address is accurate and complete.

The estimated delivery date or period is displayed on the website, during checkout or in the order confirmation.

Apex Driver remains responsible for the proper completion of delivery until the Customer, or a third party appointed by the Customer, takes physical possession of the product, unless the Customer independently selects a carrier that was not offered by Apex Driver.

In the event of a significant delay, lost parcel or undelivered order, the Customer must contact contact@apexdriver.shop. Apex Driver will make the necessary enquiries with the supplier or carrier.

Article 9 – Right of Withdrawal

Under Article L.221-18 of the French Consumer Code, a consumer Customer normally has 14 calendar days from the day after receiving the product to exercise the right of withdrawal without providing a reason.

Where several products from the same order are delivered separately, this period begins on the day after the final product is received.

The Customer may notify Apex Driver of the decision to withdraw by emailing contact@apexdriver.shop.

The Customer may also exercise the right of withdrawal online free of charge:

After signing in using the email address associated with the order, the Customer selects the relevant order and products and then confirms the request.

An acknowledgement of receipt is sent by email after the online request has been submitted. It includes the content of the request and its submission date and time.

Use of the online functionality is not mandatory. Any other clear statement expressing the Customer’s decision to withdraw may also be used.

After notifying Apex Driver, the Customer has 14 days to ship the product in accordance with the instructions and return address provided by Apex Driver.

The direct cost of returning a product following withdrawal is payable by the Customer where the Customer was informed of this before ordering.

The right of withdrawal may not apply to products manufactured according to the Customer’s personal specifications or clearly personalised at the Customer’s request.

Simply selecting a standard size, colour or product variation does not automatically make a product personalised.

Article 10 – Returns, Refunds and Exchanges

Products must not be returned directly to Printful, CJdropshipping or any other address without prior instructions from Apex Driver.

When a refund is due following withdrawal, it will be issued using the payment method used for the order unless the Customer expressly agrees to another solution.

The refund will be processed within no more than 14 days after notification of the withdrawal.

Apex Driver may delay the refund until the returned product has been received or until the Customer provides proof that it has been shipped, whichever occurs first.

The refund includes the price of the products concerned and the original standard delivery costs in accordance with applicable regulations.

Additional charges resulting from the Customer selecting an express or more expensive delivery method than the standard delivery offered will not be refunded.

In addition to the legal right of withdrawal, Apex Driver offers a voluntary clothing size exchange for 30 days under the conditions set out in the Return and Refund Policy.

This voluntary service does not limit the Customer’s statutory rights.

Article 11 – Legal Guarantee of Conformity

The consumer has a period of two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee applies to that digital content or digital service throughout the agreed supply period. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days following the request, free of charge and without major inconvenience.

Where the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer requests the repair of the goods but the Seller requires their replacement, the legal guarantee of conformity is renewed for a period of two years from the date on which the replacement goods are delivered.

The consumer may obtain a reduction in the purchase price while keeping the goods or terminate the contract and receive a full refund in exchange for returning the goods if:

  1. The professional refuses to repair or replace the goods;

  2. The goods are repaired or replaced after the thirty-day period;

  3. The repair or replacement causes major inconvenience to the consumer, particularly where the consumer permanently bears the cost of taking back or removing the non-conforming goods or bears the cost of installing the repaired or replacement goods;

  4. The lack of conformity persists despite the Seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a reduction in the price of the goods or to terminate the contract where the lack of conformity is sufficiently serious to justify an immediate price reduction or termination of the contract. In such circumstances, the consumer is not required to request the repair or replacement of the goods beforehand.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for the purpose of their repair or replacement suspends the remaining guarantee period until the repaired or replacement goods are delivered.

The rights described above result from the application of Articles L.217-1 to L.217-32 of the French Consumer Code.

A Seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity may incur a civil fine of up to EUR 300,000, which may be increased to up to 10% of the Seller’s average annual turnover, in accordance with Article L.241-5 of the French Consumer Code.

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are retained or to a full refund in exchange for returning the goods.

To make a claim, the Customer must contact contact@apexdriver.shop and provide the order number.

To facilitate the handling of the claim, the Customer is invited, whenever possible, to provide photographs or videos showing the issue. Failure to provide photographs or videos does not deprive the Customer of any statutory rights.

Article 12 – Legal Guarantee Against Hidden Defects

The Customer also benefits from the legal guarantee against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code.

This guarantee may be exercised within two years from discovery of the hidden defect, subject to the limits established by law.

Where the applicable conditions are satisfied, the Customer may keep the product and receive a price reduction or return the product and receive a refund in accordance with the law.

Article 13 – Damaged, Defective or Incorrect Products

If a product arrives damaged, has a defect or does not match the product ordered, the Customer must contact Apex Driver as soon as possible at contact@apexdriver.shop.

The request must include the order number.

To facilitate handling, the Customer is invited, whenever possible, to provide photographs or videos showing the product, packaging, shipping label and issue encountered.

Failure to provide a photograph or video does not deprive the Customer of any statutory rights.

Depending on the circumstances and applicable legal rights, Apex Driver may offer to repair or replace the product, reduce its price or issue a refund.

Apex Driver will cover any necessary return costs where a defect, damage or delivery error has been confirmed.

Article 14 – Liability

Apex Driver does not exclude or limit the Customer’s statutory rights, including the right of withdrawal, legal guarantee of conformity, legal guarantee against hidden defects and delivery rights.

Apex Driver will not be liable for damage caused exclusively by abnormal or improper use of a product, failure to follow instructions, an alteration made by the Customer or use inconsistent with the product’s normal purpose.

Nothing in these Terms limits the Seller’s liability where such a limitation is prohibited by law.

Article 15 – Force Majeure

Apex Driver will not be liable for delay or failure directly caused by an event recognised as force majeure under French law.

The Customer will be informed as soon as reasonably possible.

If performance becomes permanently impossible or the situation continues for a period allowing the contract to be legally cancelled, any amount due will be refunded in accordance with applicable law.

Article 16 – Personal Information

Personal information collected in connection with an order is used to process payment, manufacture or prepare products, arrange delivery, provide customer service and comply with Apex Driver’s legal obligations.

Article 17 – Complaints and Consumer Mediation

For any complaint, the Customer must first contact Apex Driver at:

Apex Driver will attempt to reach an amicable solution.

If the written complaint is unsuccessful, a consumer Customer may use the consumer mediation service appointed by Apex Driver free of charge.

Article 18 – Governing Law and Jurisdiction

These Terms are governed by French law.

Customers residing in another country continue to benefit from any mandatory consumer protection provisions applicable in their country of residence that cannot lawfully be excluded.

If a dispute cannot be resolved amicably or through mediation, the competent courts will be determined in accordance with applicable legal rules.

Nothing in these Terms deprives consumers of the right to bring proceedings before a court made available to them by law.

If there is a discrepancy between the French version and a translation, the French version will prevail to the extent permitted by applicable law.
